Terms of Service — WaterGiraffe

1. Licence

Hiren Paghadal grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for personal, non-commercial use, in accordance with these Terms and the rules of the platform store you obtained the App from (Google Play or the Apple App Store).

The App and all its source code, designs, mascots, fonts, copy, and brand marks remain the property of Hiren Paghadal or the App’s licensors.

2. Acceptable use

You agree not to:

• Use the App in any way that violates the law where you live or where you use it.
• Resell, sub-licence, rent, or otherwise commercially redistribute the App or any of its assets without written consent.
• Reverse-engineer, decompile, or attempt to derive source code from the App, except to the extent that this restriction is prohibited by applicable law.
• Use the App to harass, threaten, or impersonate another person (including in Friends and Challenges).
• Attempt to bypass paywalls, manipulate purchase receipts, or interfere with the App’s security or rate-limit protections.
• Use automated means (bots, scripts) to interact with the App or its backend services beyond what the App’s own interface offers.

We may suspend or terminate accounts that materially breach these rules — see Section 9.

3. Your account and your content

You are responsible for keeping your account credentials safe. Activity that happens through your account is your responsibility unless and until you tell us the account was compromised.

You retain ownership of the content you put into the App — hydration logs, display name, profile photo, custom drink types, challenge messages. You grant us a worldwide, royalty-free licence to store, process, and display that content only as needed to operate the App for you and (for content you choose to share) the friends you accept.

You are responsible for ensuring you have the right to share any photo, name, or other content you upload.

4. Third-party services

The App integrates with the following third-party services. Your use of those services is also governed by their own terms:

• Supabase — account, optional cloud sync, social features (terms)
• Anthropic — Weekly Insight via the Claude API (terms)
• RevenueCat — subscription receipt validation (terms)
• Open-Meteo — weather data (terms)
• Open Food Facts — product lookups (terms)
• Google Health Connect (Android) — system hydration interop (terms)

We are not responsible for the availability or behaviour of those services. The data we share with each is described in our Privacy Policy.

5. Intellectual property

All rights in the App, including the WaterGiraffe name, the giraffe mascot (“Character Vessel”), the Serene Hydration design system, copy, art, animations, fonts (under their respective licences), source code, and any future updates, are owned by Hiren Paghadal or licensed to us.

These Terms do not grant you any right or licence in our trademarks. Google Play, Health Connect, Apple App Store, and any other third-party marks belong to their respective owners.

6. Disclaimer of warranties

WaterGiraffe is not a medical device. It is a self-tracking tool designed for general wellbeing. It does not diagnose, treat, cure, or prevent any disease. The goal calculations, weather adjustments, and Weekly Insights are general guidance only. Consult a qualified healthcare professional for any decision about your hydration or health, especially if you have a medical condition, are pregnant, or take medication that affects fluid balance.

The App is provided “AS IS” and “AS AVAILABLE”, with all faults and without warranty of any kind, whether express, implied, or statutory, including (without limitation) implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and quiet enjoyment.

We do not warrant that the App will be uninterrupted, error-free, free from security vulnerabilities, or that any defects will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions the exclusions above apply to the maximum extent permitted by law.

7. Limitation of liability

To the maximum extent permitted by law, neither Hiren Paghadal nor any of the App’s contributors, licensors, or service providers will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, business opportunity, or other intangible loss, arising out of or in connection with your use of (or inability to use) the App.

In any event, our total aggregate liability arising out of or in connection with the App or these Terms will not exceed the greater of:

• The amount you paid Hiren Paghadal for the App in the 12 months before the claim, or
• ₹1,000 INR / USD 12.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including, where relevant, liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).

8. WaterGiraffe Pro subscriptions

WaterGiraffe Pro is sold as an auto-renewing subscription through Google Play or the Apple App Store.

• Billing. Your store account is charged at the price shown at checkout. The subscription renews at the end of each period at the then-current price unless you cancel.
• Trial. Where offered, the trial converts to a paid subscription unless cancelled at least 24 hours before the trial ends.
• Cancellation. Manage or cancel any time in your Google Play subscriptions screen or Apple ID subscriptions screen. Cancelling stops the next renewal; the current period continues until its end date.
• Refunds. Refunds are handled by the store you bought from, under its own policies (Google Play Refund Policy / Apple Media Services Terms). We cannot refund a store purchase directly.
• Feature changes. Pro features may be added, changed, or removed; if a material Pro feature is removed during a paid period and you have not used the App since the change, contact us for a pro-rated refund consideration.

If the App is offered as a free download in your region, no charges apply until you choose to subscribe.

9. Termination

You can stop using the App at any time and uninstall it from your device. Account deletion is available in-app and via email — see the Account Deletion guide.

We may suspend or terminate your access to the App or your account if we reasonably believe you have materially breached these Terms or applicable law, or if continued operation would create a security, legal, or financial risk. Where practical we will notify you first and give you a chance to resolve the issue.

Provisions that by their nature should survive termination (including ownership, disclaimers, liability limits, and governing law) will survive.

10. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. You and Hiren Paghadal agree to submit to the exclusive jurisdiction of the courts of Rajkot, Gujarat, India for any dispute arising out of or in connection with the App or these Terms, except where mandatory consumer-protection law in your country of residence gives you a non-waivable right to bring proceedings locally.

Before starting formal proceedings we both agree to attempt to resolve the dispute by writing to contact@hirenpaghadal.in and engaging in good-faith discussion for at least 30 days.

11. Changes to these Terms

We may update these Terms from time to time. If a change is material we will notify accountholders in the App and by email at least 14 days before it takes effect. Continued use of the App after the effective date of a change means you accept the new Terms. If you do not accept, please delete your account and uninstall the App.
