Terms of Use — Cartoon Video
These Terms of Use (“Terms”) govern your installation and use of the Cartoon Video Android application (“the App”). By installing or using the App you agree to these Terms. If you do not agree, please uninstall the App. The App is intended for use by children with parental supervision; the parent or legal guardian who installs the App accepts these Terms on behalf of the household.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on Android devices you own or control, for personal, non-commercial family viewing only. This licence does not transfer any ownership of the App, its source code, illustrations, brand, or accompanying content to you. All rights not expressly granted are reserved.
2. Acceptable use
You agree not to, and you will not permit anyone using your device to:
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent expressly allowed by applicable law.
- Modify, adapt, translate, or create derivative works based on the App or its assets.
- Bypass, disable, tamper with, or circumvent the parent PIN, content filters, watch-time limits, bedtime lock, blocklists, or any other safety or security feature.
- Scrape, mass-download, rehost, or otherwise extract videos played through the YouTube IFrame embed. The App does not download videos, and you must not attempt to use the App as a tool to do so.
- Use the App to access, distribute, or store content that is unlawful, infringing, harmful to children, or otherwise inappropriate for the App’s intended audience.
- Resell, rent, sub-licence, or commercially exploit the App or any premium subscription accessed through it.
- Use the App in any way that violates YouTube’s Terms of Service, Google Play’s Terms of Service, or applicable laws of your jurisdiction.
You must be at least 18 years of age, or otherwise of legal majority where you reside, to install the App, accept these Terms, and purchase any subscription on behalf of your child.
3. Your account and parental responsibility
The App does not require user accounts. The parent who installs the App is responsible for:
- Configuring and safeguarding the parent PIN.
- Choosing which child profile, age group, and content filters are appropriate for their child.
- Supervising their child’s use of the App, including the videos played and time spent.
- Reviewing this page and the Privacy Policy before allowing a child to use the App.
You acknowledge that we do not, and cannot, monitor every household’s usage. Sole responsibility for what your child watches and how long they use the App rests with you.
4. Third-party services
The App depends on the following third-party services. Your use of the App is also subject to their terms:
- YouTube(Google LLC) — video playback via the official IFrame embed. Subject to the YouTube Terms of Service.
- Firebase / Google Cloud— Crashlytics, Remote Config, Cloud Messaging, Analytics, and Firestore. Subject to the Google APIs Terms of Service and the Firebase Terms of Service.
- Google Play Billing— subscription processing on Android. Subject to the Google Play Terms of Service.
We are not responsible for the availability, accuracy, or terms of these third-party services. Outages, policy changes, or geographic restrictions imposed by these providers may affect the App.
5. Subscriptions, billing, and refunds
The App may offer optional auto-renewing premium subscriptions, processed exclusively through Google Play Billing.
- The price, billing period, and free-trial terms (if any) are presented in-app at the time of purchase by Google Play.
- Payment is charged to your Google Play account at the start of the billing period. Subscriptions automatically renew until cancelled.
- You can cancel at any time from your device’s Play Store → Subscriptions screen. Cancellation takes effect at the end of the current billing period.
- Refunds are handled by Google Play in accordance with the Google Play refund policy. We do not directly process refunds.
- If your subscription lapses or is refunded, premium features are deactivated on the device the next time the App reconciles with Google Play.
6. Intellectual property
The App’s source code, design system, original illustrations, mascot, copy, brand name, logo, and selection and arrangement of the safe-content catalog are owned by Hiren Paghadal or licensed to us. They are protected by copyright, trade-mark, and other applicable laws. You may not copy, distribute, or create derivative works from them without prior written permission.
Videos played through the App are owned by their respective creators and are made available by YouTube. Nothing in these Terms transfers any rights to that third-party content to you.
7. Disclaimer of warranties
The App is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by applicable law. In particular, we do not warrant that:
- The App will be uninterrupted, error-free, secure, or free from harmful components.
- The safe-content catalog will be exhaustive, up-to-date, or appropriate for every child in every context.
- Any third-party service used by the App (YouTube, Firebase, Google Play) will be available at any given time.
- The App will be compatible with every Android device, version, or hardware configuration.
You use the App at your own risk. We make no warranty that any third-party content displayed within the App is suitable for your specific child; you remain the final judge of what is appropriate for your family.
8. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Hiren Paghadal or our affiliates, licensors, or service providers be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of, or inability to use, the App.
Our total aggregate liability arising out of or related to the App, however caused, shall not exceed the greater of (a) the amount you paid us for the subscription in the twelve months preceding the claim, or (b) ₹1,000 / USD 12.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.
9. Termination
We may suspend or terminate your right to use the App at any time, without notice, if you breach these Terms or use the App in a manner that puts children or third parties at risk. You may stop using the App at any time by uninstalling it.
On termination:
- The licence granted in Section 1 ends immediately.
- Sections 6 (Intellectual property), 7 (Disclaimer of warranties), 8 (Limitation of liability), 10 (Governing law), and 12 (Contact) survive termination.
- Any active subscription continues to be governed by Google Play’s terms until you cancel or it expires.
10. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws rules. The courts located in Rajkot, Gujarat, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the App.
Before initiating a formal proceeding, you agree to first contact us at privacy@hirenpaghadal.in with a description of the dispute, so that we may attempt to resolve it informally within thirty (30) days.
11. Changes to these Terms
We may revise these Terms from time to time. When we do, we will update the “Effective” date at the top and, where the changes are material, surface a notice in the Parent Zone the next time you open the App. The current version is always available at hirenpaghadal.in/cartoon-video-tv/terms. Your continued use of the App after a change takes effect constitutes acceptance of the revised Terms.
